Which licenses? A set of 11 popular open-source licenses that all require attribution of the author's name and copyright, including the MIT license, the GPL, and the Apache license. (These are enumerated in the appendix to the complaint.)
In addition to violating the attribution requirements of these licenses, we contend that the defendants have violated:
GitHub's own terms of service and privacy policies;
DMCA § 1202, which forbids the removal of copyright-management information;
the California Consumer Privacy Act;
and other laws giving rise to related legal claims.

When at all possible, I purchase music from Bandcamp, because of all the options available, that is the one where the artists make the most money.

When an album is not available on Bandcamp (as often happens with bands signed to major labels who contractually prohibit the bands from making their music available on Bandcamp) I have been using Qobuz, which seems to be the least-bad second option at this time. The files are high quality and DRM-free.

Three months after Google de-listed XScreenSaver from their "Play" [sic] store, the Google "Play" Console Team are now suddenly very concerned about "Android vitals bad behavior for XScreenSaver", the app that they will no longer allow anyone to download.

My app "is likely to become less discoverable" and "a warning is likely to be shown", you see.

This may be a Susan Collins level of "concerned". Someone let me know when they have escalated this to "deeply concerned".

The broken image for the XScreenSaver logo in the email is just *chef kiss*.

I gave up on writing book reviews a while ago, but I have a story about 1984.

Julia is a recent re-telling of 1984 with you-know-who as the narrator. It takes the positions that A) Winston Smith is kind of a shitty person, and B) fascists are not nearly as smart as they tell you they are. Though it contains a few credulity-stretching coincidences, I enjoyed it a lot.

Before reading it, I thought I should re-read 1984, and that was a good call, because the way the plot, and even some of the dialog, line up between the two novels is well done.

Re-reading 1984 just after the 2024 presidential election probably counts as self-harm. "But I went ahead and did it just the same."

I last read 1984 when I was a teenager, but imagine my surprise when I, a book hoarder, went to my shelves and did not have a copy of it! This means that either I read it while sitting on the floor in the library stacks, or it was assigned in school and I had to give it back. So I went to bookshop.org and ordered the first copy there.

Even though it had been like a thousand years since I last read it, I still remembered every particular of the plot vividly. But the one thing that I didn't remember was, it's actually a great book! I expected it to be a constant bummer and kind of a slog, but it's actually really tightly written with interesting characters. And it goes hard.

So here's the weird part: as I'm reading it, I keep noticing all of these odd typos. Newlines where they shouldn't be. Missing paragraph breaks. An extra "f" at the end of a line for no reason. For a book that's like 80 years old, you'd think the copy-edit phase of its life would be over by now, right? So I flip to the colophon, and this book is copyright by some company in India, not by the notoriously litigious Orwell estate!

OMG, did they just pirate this shit? Are these typos trap typos, like trap streets on maps? Is this OCR slop? Julia, of course, worked in Pornosec, producing books "composed entirely by mechanical means on a special kind of kaleidoscope known as a versificator". This all felt just a little too on-the-nose, so I gave away that obviously-accursed copy of the book and ordered an ancient, yellow, dog-eared copy from eBay whose cover looked familiar.

This one smells right.

Hout says he'd tried to block the AI plan since August, but Chrome and Cleopatra are firm on it. So Hout is finally quitting instead -- Saturday's show at DNA Lounge was his final Dead Boys show.
Chrome and Cleopatra issued a statement that that guy was fired because he sucked anyway. Chrome assured fans it would not be an "AI record.". But Hout quoted the contract:
Artist has agreed that such Performances shall be Vocal performances (the "Performances") utilizing artificial intelligence (AI) technologies for purposes of creating works based on the original voice of Stiv Bators, to be used on Company's master recordings of the songs ...

The plan was apparently for Hout to record a guide vocal that would then be reskinned with the "fakeass robot A.I. Stiv Bators voice."
Cleopatra is best known for its middling punk and goth rock exploitation compilations in the 1990s, so it's hard to say this is out of character for them.

Hello! Here is an extremely stupid update about some incredibly low-stakes bullshit that doesn't matter at all! Oh for the glory days when this was the kind of thing I got worked up about.

Barely six weeks after the XScreenSaver for Android Privacy Policy fiasco, which led to a quite nice piece of writing if I do say so myself, Google decided that if I would not give them a copy of my driver's license, they were going to remove XScreenSaver and XDaliClock from their "Play" [sic] store.

They have now done so.

And I'm all broken up about it.

So you'll have to download those APK files from my web site directly.

Since I enjoy wasting the time and money of multinational superpredators, here's how that discourse went. They have not yet closed the ticket, but since it has now been nearly a month since they last replied, I think we know how this is going to go.

The islands would be handed over to the neighboring island country of Mauritius, about 1,100 miles off the southeastern coast of Africa. [...]
Once this treaty is signed, the British Indian Ocean Territory will cease to exist. Various international bodies will update their records. In particular, the International Standard for Organization (ISO) will remove country code "IO" from its specification. Slovenian academics traveled to Serbia at the end of 1992. Their destination was the University of Belgrade in the country's capital. On arrival, they broke into the university and stole all the hosting software and domain records for the .yu top-level domain -- everything they needed to seize control. For the next two years, the .yu domain was unofficially operated by ARNES (Academic and Research Network of Slovenia), which repeatedly denied its involvement in the original heist. ARNES rejected all requests by Serbian institutions for new domains, severely limiting the country's ability to participate in the growing internet community. The situation became so messy that, in 1994, IANA founding manager Jon Postel personally stepped in and overrode IANA regulations, forcibly transferring ownership of the .yu domain back to the University of Belgrade. Mozilla's Original Sin

Some will tell you that Mozilla's worst decision was to accept funding from Google, and that may have been the first domino, but I hold that implementing DRM is what doomed them, as it led to their culture of capitulation. It demonstrated that their decisions were the decisions of a company shipping products, not those of a non-profit devoted to preserving the open web.

Those are different things and are very much in conflict. They picked one. They picked the wrong one.

In light of Mozilla's recent parade of increasingly terrible decisions, there have been cries of "why doesn't someone fork it?" followed by responses of "here are 5 sketchy forks of it that get no development and that nobody uses". And inevitably following that, several people have made comments in the "Mozilla is an advertising company now" thread to the effect that it is now impossible for a non-corporate, open source project to actually implement a web browser, since a full implementation requires implementing DRM systems which you cannot implement without a license that the Content Mafia will not give you.

This is technically true. ("Technically" being the best kind of "true" in some circles.)

Blaming and shaming:

It used to be that to watch Netflix (and others) in an open browser required the use of a third party proprietary plugin. That doesn't work any more: now Netflix will only work in a browser that natively implements DRM.
That step happened because Mozilla took that license and implented DRM.
That happened because: "it's in the W3C spec, we didn't have a choice."
How did it get into the spec? Oh, it got into the spec because when the Content Mafia pressured W3C to include it, Mozilla caved. At the end of the day they said, "We approve of this and will implement it". Their mission -- their DUTY -- was to pound their shoe on the god damned table and say: "We do not approve, and will not implement if approved."
But they went and did it just the same.

"But muh market shares!" See, now we're back to the kitten-meat deli again.

(BTW, how's that market share looking these days? Adding DRM really helped you juice those numbers, did it? Nice hockey-stick growth you got there? Good, good.)

If you were unable to watch Netflix in Mozilla out of the box, yes, that would have impacted their market share. You know what else would have happened? Some third party patch would have solved that problem.

When Netscape released the first version of the Mozilla source with no cryptography in it due to US export restrictions, it was approximately 30 minutes before someone outside the US had patched it back in. I'm not exaggerating, it happened that night. This is the sort of software activism at which the open source community excels, even if it is "technically" illegal. ("Technically", again, being the best kind of illegal in some circles.)

Mozilla had a duty to preserve the open web.

Instead they cosplayed as a startup, chasing product dreams of "growth hacking", with Google's ad money as their stand-in for a VC-funding firehose, with absolutely predictable and tragic results.

And those dreams of growth and market penetration failed catastrophically anyway.

(Except for the C-suite, who made out quite well. And Google, who got exactly what they paid for: a decade of antitrust-prosecution insurance. It was never about ad revenue. The on-paper existence of Firefox as a hypothetical competitor kept the Federal wolves at bay, and that's all Google cared about.)

Now hear me out, but What If...? browser development was in the hands of some kind of nonprofit organization?

In my humble but correct opinion, Mozilla should be doing two things and two things only:

Building THE reference implementation web browser, and
Being a jugular-snapping attack dog on standards committees.

The George Carlin AI Standup Is Worse Than You Can Imagine

The cursed hour-long special is the work of Dudesy, a podcast hosted by Will Sasso and Chad Kultgen and curated by an AI program with the same name.

The AI comedian, which is not funny and only sounds vaguely like Carlin, spends the hour riffing on various topics like Taylor Swift, U.S. gun culture -- and of course, hyping the supposedly revolutionary potential of AI technology.
Carlin's family did not give Dudesy permission to create the special, and his daughter, Kelly, publicly denounced it. "My dad spent a lifetime perfecting his craft from his very human life, brain and imagination. No machine will ever replace his genius," she wrote. "These AI generated products are clever attempts at trying to recreate a mind that will never exist again. Let's let the artist's work speak for itself. Humans are so afraid of the void that we can't let what has fallen into it stay there."

Given that this thing appears to be largely a commercial for "AI", it's a bit credulous to take them at their word that the script was "written" by software, and not heavily edited by human hands. [citation], as the kids say, [needed].

Still monstrous either way.

George Carlin Estate Threatens Legal Action Over AI Special:

She is used to trying to chase down every false meme. "But this is different. This is just a whole other can of worms," she tells us. "I mean, ultimately, there is enough real George Carlin in the world that this little thing is not going to make a difference, but this is the tip of the spear. This is the barn door, you know, how many metaphors can I use for this? We must take a stand as artists, and those who take care of the legacies of artists."
Will Sasso and Chad Kultgen, the duo behind the Dudesy platform that created the new hour [...] act as if they're just two funny dudes at the mercy of an artificial intelligence they've collaborated with that somehow decided -- nine months after receiving a cease-and-desist order from Tom Brady's lawyers to take down their supposedly AI-generated comedy routine from the NFL great -- that it'd be a bright idea to regurgitate the recorded material of the late George Carlin to spit out a "new" hour of comedy Tuesday based on current events. They act as if their AI collaboration came up with the Carlin stunt all on its own, listening to the announcement with shocked looks on their faces.

Can't wait to find out if "MST3K cosplay" functions as a legal defense.
